Games Are Art

The act forbidding sale or rental of violent games to minors does not comport with the 1st Amendment.

The Supreme Court has ruled (pdf) that video games are protected under the First Amendment in the same way as art or literature.

This is the final opinion in the case of Brown v. Entertainment Merchants Association, in which California had passed a law forbidding the sale of violent video games to minors, causing them to be unstocked in major retailers and subject to the same censorship as obscene material like pornography. The ruling in this case is a landmark for the recognition of video games as Constitutionally protected artistic expression.
